This commentary challenges the conclusions reached by Franklin Miller and Robert Truog in their criticism of the President's Council's White Paper, "Controversies in the Determination of Death." I agree with much of Miller and Truog's criticism of the rationale offered by the President's Council for accepting neurological criteria for determining death but argue that they too quickly dismiss the alternative rationale of determining death by neurological criteria-i.e., the destruction of the psychophysical integrity of the human being that occurs when the (...) potential for consciousness and every other mental function is lost due to catastrophic injury to the brain. By focusing on the death of bodies instead of human beings, their view absurdly implies that decapitation would not necessarily result in one's death. Since total brain failure is a form of physiological decapitation, the neurological criterion coheres perfectly well with the ordinary understanding of decapitation as death. (shrink)

Potts Jr. (bio)In December 1997, the Institute of Medicine (IOM) released a report on medical and ethical issues in the procurement of non-heart-beating organ donors. This report had been requested in May 1997 by the Department of Health and Human Services (DHHS). We will here describe the genesis of the (...) IOM report, the medical and moral concerns that led the DHHS to sponsor it, the process of producing it, and its conclusions. The analyses, findings, and recommendations of the report are also reviewed, in particular the central issues that led to suggestions for policy changes.Transplantation BackgroundAs a first step, some background in the relevant aspects of organ transplantation will prove useful. For the purposes of this analysis, “transplantation” involves the transfer of cells, tissues, or solid organs from one human to another to replace the structure or function of comparable body components that, through injury or disease, are defective or of inadequate function. The IOM report deals with solid organs, primarily kidneys and livers, whose blood supply is reconnected in the organ recipient, in contrast to cells, like bone marrow, and tissues, like corneas. A variety of donor types exists for organ transplantation, each with particular medical and scientific conditions.Living donors are healthy (and usually genetically related) individuals who volunteer to provide either a whole, paired organ such as a kidney or a section of an organ such as a liver. Cadaver donors are individuals who have died and from whom a full array of organs can be taken. “Heart-beating” cadaver donors are individuals who have suffered “brain death,” that is, irreversible cessation of function of the whole brain including the brain stem; and “non-heart-beating” donors (NHBDs) are individuals who are ill or injured, but not “brain dead,” and who have suffered cardiopulmonary death, that is, irreversible cessation of cardiac and respiratory function. NHBDs can be “controlled,” which means that [End Page 83] they can be sustained by artificial life support systems until a medical and family decision is made to terminate futile life support. This can be done at a scheduled time and in a controlled manner, and organs can then be recovered for transplantation. NHBDs can also be “uncontrolled,” which means that their hearts and breathing have stopped through disease or injury at an unexpected time or in an uncontrolled manner, and they cannot be resuscitated; the organs of some individuals of this description can be recovered for transplantation. Mark Henninger, Harvard University Press, 2013The ongoing and apparently interminable debate over the moral and legal status of abortion has come over the years to resemble the Western front in World War I, with two contending armies facing each other with limited maneuvering (...) room, familiar and overused weapons, periodic artillery barrages, increasing casualties, not much new to report, and a deadly ‘no man’s land’ between them in which virtually nothing survives. Against the gloomy monotony of the abortion wars, in which reductivist accounts of the opponents’ views and repetitious restatements of familiar and cherished views predominate, this book by Fabrizio Amerini, a professor of philosophy at the University of Parma, appears as a refreshing surprise. It is surprising for a number of reasons, which I shall present later. But its refreshing character comes primarily from its moderate tone and the care with which its arguments are presented. Amerini is clearly familiar with the Catholic tradition on abortion and euthanasia; he is respectful of this tradition, which he does not directly challenge, but his sense of scholarly integrity prevents him from simply presenting Aquinas as a defender and synthesizer of all the positions championed in that tradition or by its papal custodians. He has an impressive command of the relevant texts in Aquinas and the Fathers of the Church, which he joins with a scrupulous style of [End Page E-103] philosophical argument which has an affinity with the clarifying labors of G. E. Moore in the early days of analytic moral philosophy. The result is not easy reading, but the reader can be confident that the desire to score rhetorical points and political victories will not distort the philosophical and historical analysis. The book is intended primarily for those who can benefit from careful scholarship, but it should be instructive for all who regard the questions of abortion and euthanasia as genuinely difficult and as deserving our best intellectual efforts.The most important surprise is Amerini’s focus on the issue of delayed versus immediate hominization in the development from embryo to complete human being. Since Pius IX in 1867, the Vatican has insisted that from the moment of conception the embryo becomes a human person whose life is sacred and deserves full protection. This view is ordinarily discussed as ‘immediate hominization’. In Amerini’s view, the embryo lacks the development and differentiation of organs which would enable it to have a sustainable potentiality to perform the acts which are proper to a human person, particularly reasoning and choosing. In the Vatican’s view, the soul is immediately infused by God, though it obviously requires many years of development before it is able to function as a complete and distinct human person. Amerini regards this position as untenable within Aquinas’s metaphysical system and finds in Aquinas’s own texts evidence that he teaches a discontinuous process in fetal life. Amerini regards the insistence on immediate hominization as an arbitrary effort to maintain an absolute uniformity of moral status in all the stages of embryonic and fetal life. He sees the Vatican’s position as leading to an equation of abortion and homicide which he regards as unjustified. He does, however, affirm that there is an identity of subject running from the embryo to the developed person and also that this grounds an ethic of respect for life in all of its stages. The practical conclusions in bioethics he would draw from this position “could allow space for a judicious and discriminating ethical evaluation of individual cases,” as he puts the matter in the concluding sentence of the book.Other surprises are the author’s discovering from a careful reading of Aquinas’s texts that he taught a progressive plurality of substantial forms in the development of the embryo. Although this is a work of biography rather than of philosophy, in presenting the life of a philosopher like de Tracy a good deal of attention is necessarily paid to presenting his thought. The author provides extensive discussions of the five volumes of the Elements d’ideologie, including the Grammaire, the Logique, and the Traité de la volonté et de ses effets. In addition, he describes how de Tracy developed his science to apply to political economy, morals, and politics. In both (...) cases the author seeks to show how de Tracy’s thought takes its bearings from his experiences in revolutionary France and from his readings of Locke, Condillac, Helvetius, d’Holbach, Diderot, and Voltaire. While preserving the materialist presuppositions of these antecedents, de Tracy’s originality, according to Kennedy, lies in applying their materialism to a novel theory of movement. Further, in applying this theory of movement to human things, de Tracy prepares for the modern historical interpretation of ideology. Unfortunately, the author does not elaborate what precisely distinguishes de Tracy’s theory of movement from similar theories in the Epicurean tradition which he follows. Further, he does not explain how de Tracy’s application of this theory of movement to history, at the same time as Hegel, affects the historical interpretation of "ideology" in a way that differs from Hegel and that yet explains the evolution of the concept of "ideology." We may conjecture that de Tracy’s incipient philosophy of history adumbrates later materialist theories of historical development as encountered in Comte, whom he inspired, or in John Stuart Mill, who as a young man had been acquainted with de Tracy. But this does not distinguish "the ideologue" from Voltaire, who is often credited with originating the philosophy of history and who was a source of de Tracy’s thought in so many other respects. Holdsworth (bio)On 18 September 2008, the U.S. Food and Drug Administration (FDA) issued a draft set of guidelines for those involved in developing genetically engineered animals with heritable recombinant DNA (rDNA) constructs and is requesting comment from industry and the public about their content. The document does not impose new regulations but details (...) how existing laws and regulations apply to genetically engineered (GE) animals and offers advice to developers on how to negotiate the laws in the most efficient and productive manner. The draft guidance document is not legally enforceable at this juncture, but the guidelines are recommendations reflecting the FDA's "current thinking on a topic."The modification of GE animals being developed for commercialization, which are the focus of the document, fall into six categories: modifications intended to (1) enhance food quality—e.g., faster growing fish and meats with better nutritional profiles; (2) improve animal health via increased resistance to disease—e.g., mastitis in dairy cattle and Bovine Spongiform Encephalopathy (BSE); (3) create so-called "biopharm" animals capable of producing therapeutic products such as insulin, clotting factors, and tissues for human transplantation; (4) reduce the barriers to human animal interaction—e.g., hypoallergenic pets; (5) develop valid animal models of human disease—e.g., Parkinson's disease, Lesh-Nyhan's syndrome, and cancer; and (6) improve production of industrial or consumer products such as fiber. [End Page 393]Before proceeding to a review of the draft guidelines, it is important briefly to set the controversies around GE animals in historical and ethical context.The Ethical DebateFrom its inception, the intentional genetic modification or genetic engineering of molecules, plants, and animals by the techniques of gene splicing has consistently elicited strong responses from both the scientific community and the public. There are some data to suggest that although the concerns of scientists fall primarily into the category of possible biohazards, those of the public also reflect great concern about the intrinsic moral issues, such as whether there is something fundamentally wrong with this line of work, making it a form of forbidden knowledge (see, e.g., Gaskell 1997). When news of Paul Berg's attempts in 1970 to graft the primate tumor virus (SV 40) onto the intestinal tract bacteria Escherichia coli for the purpose of studying how normal cells may be transformed into cancerous cells was shared with colleagues, he was strongly encouraged to reflect on the potential public health risks if somehow the altered bacteria broke containment and entered the environment. Thanks to Berg's leadership, these concerns soon resulted in conferences held in Asilomar, California, and New Hampton, New Hampshire, where the ethical responsibilities of microbiologists involved in this research were discussed. These initial discussions resulted in what has come to be known as "The Moratorium Letter" (Shattuck 1996) published in the journal Science in 1974. This letter, signed by 11 leaders in the field, actually recommended restrictions on several types of experiments that were considered to be particularly risky and stated "that adherence to our major recommendations will entail postponement or possibly abandonment of certain types of scientifically worthwhile experiments" (Berg 1974). An international conference on the issues came to similar conclusions about the need for a research moratorium for the sake of public safety. On June 11, 1963, in a dramatic gesture that caught the nation's attention, Governor George Wallace physically blocked the entrance to Foster Auditorium on the University of Alabama's campus. His intent was to defy Attorney General Nicholas Katzenbach, sent on behalf of the Kennedy administration to force Alabama to accept court-ordered desegregation. After a tense confrontation, President Kennedy federalized the Alabama National Guard and Wallace backed down, allowing Vivian Malone and James Hood to become the first African Americans (...) to enroll successfully at their state's flagship university. That night, John F. Kennedy went on television to declare civil rights a "moral issue" and to commit his administration to this cause. That same night, Medgar Evers was shot dead. In The Schoolhouse Door, E. Culpepper Clark provides a riveting account of the events that led to Wallace's historic stand, tracing a tangle of intrigue and resistance that stretched from the 1940s, when the university rejected black applicants outright, to the post-Brown v. Board of Education era. We are there in July 1955 when Thurgood Marshall and lawyers at the NAACP Legal Defense Fund win for Autherine Lucy and "all similarly situated" the right to enroll at the university. We are in the car with Lucy in February 1956 as university officials escort her to class, shielding her from a mob jeering "Lynch the nigger," "Keep 'Bama white," and "hit the nigger whore." Clark exposes the many means, including threats and intimidation, used by university and state officials to discourage black applicants following the Lucy episode. And he explains how University of Alabama president Frank Anthony Rose eventually cooperated with the Kennedy administration to ensure a smooth transition toward desegregation. We also witness Robert Kennedy's remarkable face-to-face plea for Wallace's cooperation and the governor's adamant refusal: "I will never submit voluntarily to any integration in a school system in Alabama." As Clark writes, Wallace's carefully orchestrated surrender would leave the forces of white supremacy free to fight another day. And the Kennedys' public embrace of the civil rights movement would set in motion a political transformation that changed the presidential base of the Democratic party for the next thirty years. : A comparison of casuistry with the strain of particularism developed by John McDowell and David Wiggins suggests that casuistry is susceptible to two very different mistakes. First, as sometimes developed, casuistry tends toward an implausible rigidity and systematization of moral knowledge. Particularism offers a corrective to this error. Second, however, casuistry tends sometimes to present moral knowledge as insufficiently systematized: It often appears to hold that moral deliberation is merely a kind of perception. The aim of this article is to propose a taxonomy of speakers from a socio-pragmatic perspective by taking an original approach to the study of single-turn political discourse, that is, political speeches, rather than debates, interviews or press conferences. This limitation on the scope of the study stems from the fact that the categorisation advanced is not concerned with turn-taking, but concentrates on the speaker’s use of other voices in his/her representation of reality. Thus, a clear distinction is made between (...) the speaker and the sayer, namely the original speaker whose words are reported, or rather creatively reconstructed, by the current speaker ‘here and now’. The taxomony comprises a number of categories employed strategically by the current speaker in the service of different objectives. The speaker categories are inherently limited due to a single principle of categorisation: the form of the report. The singular speaker is the default type which enables the speaker to present himself/herself as an individual as well as his/her attitudes, values and beliefs, while the collective speaker enhances the speaker’s belonging to a group and allows him/her to speak on behalf of its members. The sayer categories, by contrast, are more varied due to three independent principles of categorisation: the form of the report, the genuineness of the sayer’s utterance and the number of accounts embedded in the narrating event. The approach taken to the analysis of the narrative passages that involve the proposed speaker types owes much to Chilton’s Discourse Space Theory and is concerned with conceptualisation of the speaker’s representation of events from chosen perspective. The corpus of speeches selected to investigate and illustrate individual categories consists of over 80 political speeches delivered by three Democratic American Presidents: John Kennedy, William Clinton and Barack Obama. IN A PREVIOUS study entitled, "Time, Times and the 'Right Time': Chronos and Kairos," I explored the distinction between these two aspects of time and their relations to each other. I wish to return to the topic in this paper, building on my previous discussion but bringing in some new dimensions that were unknown to me earlier on. I did not know, for example, that kairos, although it has metaphysical, historical, ethical and esthetic applications, is a concept whose original home, (...) so to speak, was in the ancient rhetorical traditions. A recent study is aimed at recovering this important idea in the present situation. It is not insignificant that, while kairos has important philosophical implications, students of rhetoric have not been alone in neglecting it as can be seen from the fact that it is not listed in the four volume Dictionary of the History of Ideas, edited by Philip Wiener, nor is it to be found in The Great Ideas: A Syntopicon, edited by Mortimer Adler. One reason for the omission is no doubt the absence of any cognate word in English for kairos whereas its partner, chronos, appears in a host of forms throughout any English dictionary. The only exception that occurs to me is the quite rare word 'Kairotic' which is listed only in the most complete dictionaries. The loss of the concept of kairos is doubly unfortunate for, on the one hand, the idea has been of enormous significance in the past figuring essentially, for instance, in the religious traditions of the West, and, on the other hand, it expresses a most important feature of temporal process which, despite exceptions here and there, is not expressed in the concept of chronos. It is with these facts in mind that I am attempting to rehabilitate, as it were, the kairos aspect of time and to show its philosophical importance. (shrink)

Let it be clear at the outset that in reappraising Dewey's thought we have to do with no minute philosopher. In breadth of interest and range of thought he belongs with the great comprehensive thinkers of the past. And in contrast to many thinkers both in his own time and since, he had a constructive program. Philosophy for him meant more than analysis, even though analysis is an important part of the philosophic enterprise. Dewey's constructive philosophy has too often been (...) lost in polemic discussion. I subscribe to the confession made some years ago by Ernest Hocking in which he said that he began to understand Dewey when he started reading him for enjoyment and not for the purpose of showing that he was all wrong! As Dewey's work shapes up in historical perspective, it assumes a great substantiality. One may disagree and one may correct, but in comparison with philosophy of a wholly technical and professional sort, Dewey's large-minded approach to genuinely philosophic questions places him among philosophers of stature. It has been widely proposed that the Jain logical methods of linguistic analysis collectively known as anekāntavāda (manypointedness) are an extension of the Jain ethical imperative of ahiṃsā (non-harm) into philosophy as a form of intellectual tolerance and relativity--described by several scholars as "intellectual ahiṃsā"--whose genealogy and development over the past sixty-five years are given in detail. It is shown how Jains used anekāntavāda to expose the relative truth of non-Jain metaphysics, while arguing that only Jain metaphysics, which alone is (...) based on the omniscience (kevala-jñāna) of the Jina, contains absolute truth (samyag-jñāna). Examples are given of Jain intolerance of others, based on nonphilosophical literacy and historical evidence, before returning to the issue of Jain tolerance for and curiosity about non-Jain philosophical positions, in an attempt to ground future discussions of Jain tolerance and intolerance on a fuller range of Jain data and not on ideological formulations inadequately grounded in historical analysis.
